The provisions for affirmative action apply to –

  • employers with 50 or more workers or,
  • municipalities;
  • organs of State;
  • employers ordered to comply by a bargaining council agreement;
  • any employers who volunteer to comply or
  • Employers with the following annual turnover:

Affirmative Action Measures

Employers must make sure designated groups (black people, women and people with disabilities) have equal opportunities in the workplace.

Who Should Employers Talk To?

When they discuss employment equity, employers must make sure they include workers from:

  • all job categories and levels;
  • designated groups (black people, women and people with disabilities); and
  • workers who are not from designated groups.

(Based on legislation in Section 16, of the Employment Equity Act)

Non-compliance:

Failure to comply with the provisions of the Employment Equity Act (which includes the submission of Reports and drafting of Plans) may lead to fines ranging between R500,000 and R900,000.

How can we assist Employers ?  

 

  1. Help you with Conducting a workplace analysis;
  2. EEA2 (Employment Equity) and EEA4 (Income Differential) Reports.
  3. Development of goals and recommendations in line with legislation;
  4. Coordination of the establishment of an Employment Equity Committee;
  5. Coaching of the newly appointed Employment Equity Manager;
  6. Initial consultation meetings with the Employment Equity Forum/Committee;
  7. Assist with the training of the Employment Equity Forum members. 
  8. Development of the Employment Equity Plan as required by the Act;
